How Consumer Court Jurisdiction Works in India

India's consumer dispute system has three levels, introduced under the Consumer Protection Act 2019. Which one you go to depends entirely on the value of what you paid - not the compensation you're claiming.

  • District Commission takes cases where the goods or services paid for were valued up to ₹50 lakh. Most cases land here.
  • State Commission handles values between ₹50 lakh and ₹2 crore.
  • National Commission is for anything above ₹2 crore - large transactions, typically involving builders or big-ticket services.

On territorial jurisdiction: you're not stuck filing where the company is registered. You can file where the opposite party has an office, where the cause of action happened, or - for online purchases - where the product was delivered to you.

  • Complaint written on plain paper - no stamp paper required
  • Notarized affidavit confirming the facts in your complaint
  • Invoice, bill, or purchase receipt
  • Copy of the legal notice you sent to the opposite party, along with delivery proof
  • Court fee payment - demand draft or E-Daakhil receipt
  • The required number of complaint copies
  • Your ID proof
  • Any supporting material - emails, screenshots, photos, warranty cards, whatever's relevant

Q. What is the consumer court fee for a complaint worth ₹10 lakh?

A. If your total claim - goods value plus compensation - falls between ₹5 lakh and ₹10 lakh, the fee comes to ₹200. That's it. The case goes to the District Commission.

Q. Do I need a lawyer to file in consumer court?

A. No, you don't. Consumer commissions were specifically set up so ordinary people can represent themselves. Plenty of complainants win without hiring anyone. A lawyer is completely optional.

Q. Can I file a consumer complaint online?

A. Yes - the E-Daakhil portal (edaakhil.nic.in) handles online filing, document uploads, fee payment, and lets you track your case. You don't need to physically visit any office.

Q. What is the time limit for filing a consumer complaint?

A. Two years from when the cause of action arose - meaning the date you actually suffered the loss or the deficiency occurred. If you're past that, you can still apply for condonation of delay, but it's not guaranteed.

Q. Is the consumer court fee refundable if I win?

A. The commission can direct the opposite party to reimburse your litigation costs, including court fee. But that's at the commission's discretion - not automatic.

Q. What if I hold a BPL/AAY card?

A. If you have an Antyodaya Anna Yojana card and your complaint value is within ₹1 lakh, you pay zero court fee. Complete exemption.
